Shaft Grounding Systems (“SGS”) Limited Product Warranty, Disclaimer of Other Warranties, and Limitation of Damages
- Products manufactured and sold on or after March 1, 2026, by Dan J. Parker, Inc., an Oregon corporation dba DP&A Sales (“SGS”) for use within the United States of America (and not elsewhere) are warranted to materially conform to SGS’s published specifications for the period from and after the date of original shipment by SGS as set forth in the table below:

Wear Parts: Brush Ring RPM up to 3,600 3 years 20 years Non-wear Parts: For the lifetime of original user - No warranty claim will be allowed unless user promptly notifies SGS in writing of the nature of the claimed nonconformity of the product.
- This warranty does not extend repair or replacement of bearings in the user’s equipment, liability for which is hereby expressly disclaimed. Warranty claims resulting from defects in the material supplied to SGS will be referred to the manufacturer of the material for processing. SGS shall not be responsible for the material supplier’s failure to respond to the warranty claim in a manner satisfactory to the claimant.
- This warranty does not extend to any defect due to the user’s design specifications for the end product, nor to the failure to install, operate, or maintain the product in accordance with the installation, operation, and maintenance instructions furnished with each new product, nor to the negligence of others, accidents, presence of foreign matter that entered the product, acts of God, alterations, modifications, repairs, or the use of unauthorized or non-standardized parts or accessories.
- THE WARRANTY PRINTED ABOVE IS THE ONLY WARRANTY APPLICABLE TO THIS PURCHASE. SGS DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED OR STATUTORY, OR ARISING BY CUSTOM OR TRADE USAGE, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. SGS NEITHER ASSUMES NOR AUTHORIZES ANY PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE OF SGS’S PRODUCTS.
- Any affirmation of fact, description of the product, or other promise made by SGS to the user which relates to the products sold hereunder that is inconsistent with the statements above shall not be regarded as part of the basis of the bargain and shall not be deemed to create an express or implied warranty that the products shall conform to the description, affirmation or promise. The exhibition of any sample or model shall not be regarded as part of the basis of the bargain and shall not create an express warranty that the whole of the products sold hereunder shall conform to the sample or model.
- SGS’s sole liability and user’s exclusive remedy for a breach of the foregoing warranty shall be, at SGS’s sole option, labor, materials, and ground-service shipping incident to repair or replacement of the nonconforming product.
- SGS shall not under any circumstances be liable for any personal injury (whether the injury is physical, psychic or emotional), nor for any general or special, indirect, punitive, incidental or consequential damages (including without limitation down time, lost production and goodwill) of the user, its customers, employees, and agents, resulting from, arising out of, or in connection with any sale, manufacture, distribution, or any use of any product whether or not SGS has been advised of the possibility of damages.
- SGS shall not under any circumstances be liable for any cost or expense in connection with the removal or replacement of an alleged defective product or any portion thereof, including without limitation labor expenses.
- Under no circumstances shall SGS’s liability under any claim by user exceed the purchase price of the product in respect of which damages are claimed.
